I'm writing a novel, where some of the characters as the protagonist, antagonist, and "the girl" is the name of some charaters I've seen in "canceled television shows, and look alike, but there personalities and character are totally different. Ex Kilokhan the villain of Super Human Samurai Cyber Squad Kilokhon comparison to the villain of my novel. Their is an evil computer virus, but mine is a terrorist who plans sacrilege to destroy Washington DC so you can tailor this to me or have I created a gap between the two. Like the difference between the Ghost Rider who died because of the comics code, compared with the Ghost Rider, which was made by Marvel Comics.
Great puns above. And the answer is no, you can not be prosecuted for what you're currently doing. The basic test for copyright infringement is – if the average person a reasonable recognize their work as different work from what you are 'borrowing' or do they think it is the original work. Then you ok, nobody will think that his story is the cyber squad because you used a character name that sounds familiar, that are "borrowed" from some inspiration for the conduct of personality and such.
